TERMS AND CONDITIONS OF USE OF THE EPN BIH INTERNET NETWORK SERVICES


Internet is an international computer network which is not under direct control of the EPN BiH, therefore it cannot guarantee availability of services.

Services of transferring voice messages through terminal equipment connected to EPN BiH resources require permission of the competent body.

A lessee/user uses the EPN BiH Internet services and programme packages of other manufacturers entirely at her/his own risk. EPN BiH does not offer any guarantee, nor takes over any responsibility for any damage that user might suffer through using services, programme package or the Internet.

On establishing the user-provider arrangement, the lessee/user is required to provide accurate address, personal information or information about the legal person, which will be used to deliver bills for the used Internet services. In case personal information required for user registration (address, telephone number, etc.) changes, the user is required to inform EPN BiH about that.

The user agrees for EPN BiH to reserve the right to limit or discontinue, at any given moment and without prior notice, the right of access to its services, in case of “unacceptable/ banned” use by the user (as explained in more detail below). The user agrees that EPN BIH will not be held responsible for any damage caused by limiting or discontinuing service provision due to unacceptable and banned use.

Legal or natural person submitting a request for use of the Internet services on the form which required by EPN BiH, must present evidence on his/her identity and place of residence.
EPN BiH must process the request immediately or within 72 hours of submitting the request, at the latest. In the process it can: accept the request in line with the conditions from the valid price list; refuse the request, if it is not possible to connect the user to EPN BIH resources due to technical reasons.

EPN BiH provides access to Internet network, in line with conditions defined in this Rulebook, to each individual who submits a request and is able to pay the expenses resulting from use of the requested services anywhere in the area covered by EPN BiH network.

The user of Internet services, who submits a request for new service or a change in the current service he/she receives, must pay all his/her previous charges to EPN BiH on submitting the order.

Before being connected to EPN BiH resources, the applicant is required to sign a Contract on the use of Internet services within 3 days from signing the Order form.
The user-provider arrangement between the EPN BIH and the user is considered established after EPN BiH accepts the request for use of the Internet services and puts its signature on the Contract on the use of Internet services.
The rights and obligations as defined under the user-provider arrangement start from the moment when EPN BiH allows the user access to EPN BiH resources or connects the terminal equipment to EPN BiH resources, which is verified with a work order form certified by the user, in cases of access through the leased telecommunications lines.


Communication contents, information and data accessed by the user

EPN BiH provides access to information, data, programmes, photographs, video and audio contents, the ("contents") stored on its servers or obtained through EPN BiH TCP/IP network. The user accepts the risk associated with contents and accuracy of information downloaded from the Internet or EPN BiH computer network.

EPN BiH neither checks nor controls the “contents” stored by users on its servers. EPN BiH cannot ensure immediate removal of content which are contrary to "Terms and conditions of the Internet services use".

EPN BiH reserves the right to distribute messages by email or in writing to inform its users on the changes in services, new services and service improvements, as well as other information relevant for the use of the EPN BiH Internet services.


Protected contents and other rights

Protected "contents” (copyright, trademark, intellectual property rights) can be accessed through EPN BiH.

Lessee/user agrees to use these “contents” in line with law and regulations used by its owner to protect the “contents”.

Lessee/user agrees not to publish or transfer protected “contents” in any way, without consent of the "contents" owner. Any such action will result in discontinuation of the Contract on the use of the EPN BiH Internet services.

In case such data are misused by users of the EPN BIH services, EPN BIH will not bear any material, criminal or moral responsibility.


Discontinuation of services

EPN BiH will discontinue the right of the lessee/user to use the services only in case when the lessee/user fails to adhere to the Terms and conditions of the Internet services use.

The user agrees that EPN BiH has the right to remove all his/her data from its servers at the moment of disconnecting the user.

EPN BiH has the right to require the user to compensate expenses caused by unacceptable/banned use of the EPN BiH Internet services.


Misuse/unacceptable/banned use

The misuse of the Internet services is defined as unauthorised use of the Internet services on the account of other lessees, users or service providers.

Misuse of the Internet services involves the following: unauthorised connection aimed at using the Internet services;
unauthorised use of another user's password;
use of the terminal equipment for purpose other than the specified (preventing use of services by other users, in cases of dual connections);
use of Internet services for purpose other than the specified (preventing use of services by other users);
unauthorised use of terminal equipment;
unauthorised provision of services to a third person;
false categorisation of the connections (use of Internet service by a natural person for the purposes of conducting business of a legal person);
use of false identity and address for the lessee/user;
unauthorised transfer of connection.

For the purpose of undisturbed and free use, the following actions are considered unacceptable:
Illegal contents – publishing or transferring information which is in direct violation of the existing BiH or international laws;
False information - publishing or transferring information which is known or assumed to be false, use of which might damage other users;
False advertising - publishing or transferring promotional and advertisement materials containing false information, misleading statements or claims;
Sending advertisement or promotional materials to other Internet users without their consent or request, and posting them in places not assigned for such materials;
Publishing confidential information about a person, company, services or other entities;
Publishing, sending of transferring insulting, threatening, vulgar, racist or chauvinistic contents;
False identification when using Internet services;
Chain letters – publishing, sending or transferring contents offered or produced in a form of chain letters;
Inappropriate contents – publishing contents in inappropriate places (e.g. promotional materials on Usenet news groups not intended for this purpose);
Use of services and servers in any way that will directly jeopardize their normal functioning.

It is forbidden to publish or send the same contents message, regardless of the contents itself, to more than 10 Usenet news groups.

The user may not require any kind of compensation from EPN BIH based on the Contract/Request or the out-of-contract responsibility of the EPN BIH towards the user or third persons.


User name and password

On establishing the user-provider arrangement, the lessee/use obtains a user name and password (or several such user names and passwords) for the purposes of obtaining authorisation when using the services, which he/she is required to keep secret and not disclose to third persons or make public in any way. At the moment when user name and password have been used for the first time by the user, the responsibility for protecting the confidentiality of the user name and password is transferred to the user.

If the user notices or suspects unauthorised use of his/her user name and password, he/she is obliged to inform EPN BIH about this immediately.

User is responsible for all expenses resulting from the use of his/her user name up until notifying EPN BIH about the suspected unauthorised use. The user is responsible for all illegal/banned activities authorised and conducted under his/her user name.
User is responsible for covering any expenses, as well as illegal activities, that might result from use of his/her user name and password in line with EPN BiH price list, up until the moment of notifying EPN BiH on illegal use of his/her user name and password.

EPN BiH reserves the right of discontinuing user’s access to Internet services, in case of noticing unauthorised use of his/her user name and password, of which it will inform the user.

Payment of services

The lessees/users enter a user-provider arrangement with EPN BIH, connecting their devices on its network.

Subscription is a monthly amount charged to the lessee/user as a fee for making the EPN BIH resources available to subscribers, regardless of whether they use them or not. Subscription is paid in advance, and per month.

Payment of Internet services can carried out in advance (prior to service delivery), immediately upon service delivery or subsequently upon receiving the bill for provided services.

In cases when lessee/user exceeds the agreed volume of traffic, EPN BIH may disconnect him/her from traffic.

In case the Internet services price list does not stipulate price for specific services, payment of such services will be done in line with the Contract.

On establishing the user-provider arrangement, the subscription will be charged from the day when user’s terminal equipment is connected to the EPN BIH resources.


In case the user-provider arrangement is less then 30 days long, the amount of subscription fee is calculated based on charging 1/30 of monthly subscription for each day of service provision.

In case the user-provider arrangement is terminated, subscription is charged up until the day of disconnecting the user’s terminal equipment.

The lessee/user will pay one off connection fee, any expenses that may occur as part of setting up technical conditions for connection and access fee, in line with the price list, within 5 days of signing the Contract at the latest.

Period on basis of which subscription and traffic are calculated is 1 (one) month, and as a rule it is understood to start on the 1st day of current month and end on the 1st day of the next month.

The lessee/user is required to pay the bill within 8 days from receiving it.

If the lessee/user does not pay the bill within 8 days from receiving it, EPN BIH will deliver him/her a notice of unpaid bills within the following 7 days.

In the notice, EPN BIH requests lessee/user to pay the bill within 8 days from receiving the notice of unpaid bills, otherwise he/she will be temporarily disconnected from traffic.

In the lessee/user does not pay the bill upon expiry of the notice period, the user-provider arrangement is permanently discontinued. Interest on arrears stipulated by the law is charged on the amount owed by the lessee/user. EPN BIH has the right to seek payment of the outstanding amount through court.

Lessee/use may ask for discontinuation of the user-provider arrangement in writing only.

EPN BIH will charge user the basic subscription fee up until it receives a written request for discontinuation of user-provider arrangement.

Subscriber is required to pay all the expenses created as part of the EPN BIH Internet services use prior to discontinuation of the user-provider arrangement.

Should this occur, the user is required to cover all the expenses caused by this (lawyer fees, court expenses, etc.).

The lessee/user has the right to file a complaint against the amount charged to him/her within 7 days from receiving the bill. In case that irregularities or issuing of a bill with an amount that is too high are established, the overpaid amount is transferred to the user’s next bill.
